Terms & Conditions – Groups

Article 1 – Reservations

Price conditions for « groups » apply to the entire group having made an initial reservation with our services. The reservation request must indicate the composition and characteristics of the group, day, time, and nature of the services. The reservation becomes firm upon reception of the order form (or certified administrative order form), signed by the client and accompanied by, if mentioned, a deposit of 30% of the global price of the services, and this, before the end date of the option.

Article 2 – Options

Options are retained until the deadline indicated by Le Côte d’Argent. In the case of absence of confirmation accompanied by a 30% deposit, if demanded, all options are cancelled.

Article 3- Prices

The prices of services are VAT included and correspond to the current prices of the day of signature on the order form. Prices are subject to modification without notice including during the season in progress.

Article 4 – Payment of balance

The remaining balance is due 7 days before the excursion, except in the case of a prior agreement by our sales department.
A payment upon reception of invoice cannot take place, and in any case as an exception, only if it was agreed upon on the order form. In the second case, a 5€ charge will be added to the invoice.
If any other services are added during the service, their cost will be paid the same day.

Article 5 – Execution of service

The client agrees to arrive on the day and at the time stated on the order form. If this proves impossible, the client agrees to inform Le Côte d’Argent. Otherwise Le Côte d’Argent may modify the execution and or the duration of the service after having informed the client upon arrival.

Article 6 – Modification or cancellation

6.1 Modification by the client: Modification requests of confirmed reservations must be made in writing (mail, email or fax). Only those which are notified in return by Le Côte d’Argent are deemed as accepted. Any modification, partial or total, must be requested 48 hours before the date of service concerning Le Côte d’Argent, and 7 days before for any service by any external provider. Otherwise the initial amount will be invoiced. For all composed services such as full days or cruises involving one or several partners, a service charge up to 50€ can be applied after the second modification, and that for each modification.

6.2 – Cancellation by the client
Cancellations, total or partial, of a confirmed reservation must be notified to Le Côte d’Argent in writing (email or certified letter) 48 hours before the date of service for the activity related to Le Côte d’argent, and 14 days before for any service by any external provider.

6.2 a – Concerning the activity pertaining to Le Côte d’Argent, the conditions are as follows:
Cancellation date (global fees pertaining to Le Côte d’Argent) % retained
– Up to 90 days: 5% of the global pre-tax fees pertaining to Le Côte d’Argent
– From 89 to 60 days: 10% of global pre-tax fees pertaining to Le Côte d’Argent
– From 59 to 45 days: 20% of global pre-tax fees pertaining to Le Côte d’Argent
– From 44 to 30 days: 25% of global pre-tax fees pertaining to Le Côte d’Argent
– From 29 to 15 days: 50% of global pre-tax fees pertaining to Le Côte d’Argent
– From 14 to 6 days: 75% of global pre-tax fees pertaining to Le Côte d’Argent
– Less than 6 days: 100% of global pre-tax fees pertaining to Le Côte d’Argent

6.2b – Concerning external providers
The amounts retained are as follows:
Between 14 days and until 8 days before the date beginning the service: 50% of the amount of the service excluding Le Côte d’Argent plus 50€ service charge.
– Between 7 days and until 2 days before the date beginning the service : 100% of the amount of the service excluding Le Côte d’Argent plus 50€ service charge.

6.3 – Modifications by Le Côte d’Argent
For safety reasons, Le Côte d’Argent reserves the right to modify all services (change of itinerary, programme, etc) in the case of force majeur such as unfavourable weather, technical incidents, etc.

6.4 – Cancellation by Le Côte d’Argent
Le Côte d’Argent reserves the right to cancel any reservation in the case of force majeur such as and not limited to: fire, water damage, storms, inaccessibility,
This implies that in the case of unfavourable weather or an unforeseeable event which would not allow passenger safety or the safety of the boat, the Captain could decide not to honour the service.
In which case Le Côte d’Argent will propose to postpone the service to a future date or a reimbursement to the mandate.
This decision will be validated the same day in the presence of the contracting parties, Le Côte d’Argent and the mandate.
If nuisances impede the correct functioning of the boarding process, a declaration to relevant authorities will immediately be carried out for hindering of operations and endangering others.
The same applies for failure to comply with safety instructions explained by the crew as well as behaviour considered dangerous.
Le Côte d’Argent reserves the right to disembark any person behaving aggressively or in a drunken manner. The client will be able to obtain the restitution of the deposit, excluding any other compensation or damage and interest.

Article 7 – Deterioration of facilities

The boat has different equipment and furniture, the availability of these elements is an integral part of the rented space and must be identical upon return (end of service) in the case of deterioration the mandate must immediately pay the expenses relative to the restoration or justify
the declaration and necessary steps with the proper organisations in charge of covering eventual damage claims.

Article 8 – Specificities of Le Côte d’Argent

Navigational zones and moorings are to be predefined with the Captain. Rental includes a qualified crew needed to navigate and insure passenger safety. (In no way must the personnel of Le Côte d’Argent intervene in tasks that hinder their mission, except for particularities stated in the quotation. )
Elements pertaining to catering services are the following: a bar on the upper deck with a maximum capacity of 70 passengers, a main air-conditioned dining room with a central modular part and a capacity of 120 passengers.
A catering zone (galley) fully equipped for cold catering, including a dish washing machine, steamer, and a positive cold and negative cold stock area in the hold, as well as disabled accessible installations and amenities.
The other elements available for seminar services are: video screen, video projector linked to a central control station. Concerning the specific installations emanating from the ordering party, such as: supplementary sound system and lighting a technical check must be made beforehand with the Captain or the chief mechanic, and thus for any specific arrangements necessary for temporary staging.
The Captain holds ultimate responsibility for the passengers and the boat, and for this reason a précis check with the Captain concerning the capacity of the different spaces on board must be carried out beforehand (before the passengers embark). The mandatory documents to be submitted for any external provider and different from our licensed partners are : Summary of Kbis, proof of insurance and certificate of civil liability and professional authorisation number.
The services of Le Côte d’Argent must end no later than 2am at the dock, except otherwise mentioned on the validated and signed quotation.

Article 9 – Exceptions

In the hypothetical case of unfavourable weather or an unforeseeable event that does not allow for the safety of the passengers and the boat, the Captain can decided to not honour the service. In which case Le Côte d’Argent will propose to the mandate to postpone the service to a future date or a reimbursement.
This decision will be validated the same day in the presence of the contracting parties, Le Côte d’Argent and the mandate.
If in any case the service overruns the pre-established schedule mentioned and approved on the quotation, a 35€ per hour fee will be applied for each member of the external provider staff (wait staff, maîtres d’hôtel, etc).

Article 10 – Particularities (rental for a public réception event)

As part of a specific entertainment (musical or other) or the extension of an event after midnight, and to protect the environment from any disturbance, the service will take place on the Bay at an anchoring point (mooring area) pre-established by the Captain.
Entertainment on board Le Côte d’Argent that includes music with a “DJ” and dancing cannot exceed 100 passengers.
Renting Le Côte d’Argent for the evening cannot exceed 2am including the return trip to the pier 15 minutes before disembarkation of the passengers.
During the service no passengers will be allowed to transfer or disembark (except otherwise organised by the crew of Le Côte d’Argent). Embarking and disembarking on other boats and particularly in mooring areas is forbidden except pertaining to otherwise organised shuttles, covered by the client and carried out by a licensed professional.

These conditions are designed to protect the quality of the event and the respect of others imposes the mandatory presence on board of a minimum of two supplementary safety personnel members (main and upper decks). These precautionary and safety rules will be borne by the client and billed on the same basis as the necessary options for the execution of the event (cf. quotation rates, security, entertainment, etc.)
The client has the obligation to pay a security rate of the number of supplementary security personnel for every 50 passengers.
To ensure the safety of the passengers and the installations, the Captain reserves the right to modify the programme if judged necessary and this throughout the duration of service.

Article 11 – Information

Our crew is at your service to discuss the available options as well as our partners’ offers (catering, musical entertainment and lighting, oyster tasting, etc. )
Example of specific possibilities linked to different offers
Boarding site : Petit Port, Arcachon or Jetée de Bélisaire pier
The boat and its crew are made available at the pier the day of service 30 minutes before passenger boarding.
The boat returns to the departure pier 15 minutes before the end of service
Cruise: (to be firmly established with our services at the time of validation of the service).

Article 12 – Claims

Any claims pertaining to a service must be addressed to U.B.A 76, BD de la Plage 33120 ARCACHON by certified letter maximum 8 days after the service. In the event of a dispute pertaining to the application of these terms and conditions of sale and in absence of an amicable
agreement, the courts of Bordeaux will have sole jurisdiction.

Article 13 – Responsibility and Insurance

No responsibility will be accepted by Le Côte d’Argent for any damage caused by the client during the service. Damage will be billed by the service providers concerned. The client is advised to purchase an appropriate insurance contract covering possible risks. Furthermore, Le Côte d’Argent declines all responsibility for damages of any kind, to affects or objects embarked on board the catamaran Le Côte d’Argent.
